As part of the UAE’s job contract, an employer or employee may terminate the contract by giving them a written notice. The Employment Law states that a party may terminate an Employment Contract for good cause by writing to the other informing them of the decision.
Only dismissals for cause can be made in the United Arab Emirates (UAE). It is the employer’s responsibility to pay compensation if it has a legitimate reason to fire an employee. Employees are required to receive a termination notice, including a valid reason, before being fired. If a worker has not completed more than three months of service, he or she has seven days to notify the employer, whereas if he or she has been in service for more than three months, he or she has 30 days to do so. Employees working in Abu Dhabi Global Market (ADGM) may only be fired without notice if their behavior constitutes a threat to their jobs. It is permitted under Article 44 of the Labour Law to fire an employee without cause after an employer has conducted a written investigation into the employee. Employers must revoke or transfer sponsorship of an employee’s residency visa and labor card (or identity card) within 30 days of employment in the DIFC.
The UAE does not allow for a period of continuous employment. Mass termination and collective dismissal are not permitted under any of the country’s labor laws, employment laws at DIFC, or ADGM employment regulations. Each employee of a company that is being sold must be terminated individually by the seller.
What Is The Termination Rule?
There are other circumstances in which an employer may fire an employee for the same reason as under at-will employment conditions. The employer is required to schedule an improvement schedule for the employee that includes 60 or 90 days after the employee reaches a certain work ethic threshold in order to terminate the employee’s employment for cause.
