If you are planning to move to the United Arab Emirates, or are already living there, you may be wondering about the legalities surrounding hiring a maid. In the UAE, maids are referred to as domestics and are regulated by the Ministry of Human Resources and Emiratisation. According to the ministry, a domestics contract can be terminated by either the employer or the employee, but there are certain conditions that must be met in order for the termination to be considered legal.
If an employer wishes to terminate a domestics contract, they must give the employee two weeks’ notice in writing. The notice must state the reason for the termination, and the employee must be given a chance to rectify the situation if the reason is due to their own misconduct. If the employee is unable to rectify the situation, or if the employer decides to terminate the contract for another reason, the employer must pay the employee their end-of-service benefits.
An employee can also terminate their own domestics contract, but they must give the employer three months’ notice in writing. In the UAE, a minimum of three months’ pay is required to compensate for early termination. Your service will be subject to a subscription fee of $30 per year. Typically, you will have 30 days to terminate your employees’ employment. If a domestic worker is under contract, they will be released for six months prior to signing their new contract. To qualify for the pension, a domestic worker must earn a day’s worth of paid rest each week.
It is critical to provide your employees with the proper notice period in order to dismiss them and terminate their employment. The employee has the right to terminate his or her contract at any time, as long as he or she has received the required notice in the employment contract. An employer must notify the Immigration Department within seven days of terminating a domestic worker. The International Labor Organization recommends that maids work no more than 48 hours per week.
